PURPOSE AND SCOPE OF THE DOCUMENT

The policy of the Individual Entrepreneur Limarev Ivan Sergeevich (hereinafter referred to as the Contractor) regarding the processing of personal data" (hereinafter referred to as the Policy) defines the position and intentions of the Contractor in the field of processing and protection of personal data of persons in contractual, civil and other relations with the Contractor, in order to respect the rights and fundamental freedoms of every person and, in particular special features, the right to privacy, personal and family secrets, protection of one's honor and good name.

Understanding the importance and value of information about a person, as well as taking care of the observance of the constitutional rights of citizens of the Russian Federation, the Contractor ensures reliable protection of their personal data.

By the security of personal data, the Contractor understands the protection of:
personal data from unlawful or accidental access to them, destruction,
modification, blocking, copying, provision, dissemination of personal
data, as well as from other unlawful actions with respect to personal data and takes the necessary legal measures,
organizational and technical measures to protect personal data.

Processing and ensuring the security of personal data in the Contractor is carried out in accordance with the requirements of the Constitution of the Russian Federation, the Labor Code of the Russian Federation, Federal Law No. 152-FZ "On Personal Data", by-laws, other defining cases and features of personal data processing of federal laws and governing documents of the FSTEC of Russia and the FSB of Russia.

When processing personal data, the Contractor adheres to the following principles:
The Contractor processes personal data only on a lawful and fair basis;
The Contractor does not disclose or distribute personal data to third parties without the User's consent (unless otherwise provided for by the current legislation of the Russian Federation and this policy);
The contractor determines specific legitimate goals before the start of processing (including collection/receipt) of personal data;
The Contractor collects only those personal data that are necessary and sufficient for the stated purpose of processing.

The processing of personal data in the Contractor is carried out solely for the purpose of:
fulfilling the Contractor's contractual obligations to the User;
providing the user with feedback when using the Site, Services, Platforms;
sending information and advertising messages to the e-mail address specified by the User when registering on the Site (purchasing Services), etc.
providing the User with access to services, information and (or) materials contained on the Site.
Processing of personal data that does not meet the purposes of processing is not allowed.

The Contractor processes personal data only of those persons who are in contractual, civil and other relations with the Contractor, namely:





persons who are in an employment relationship with the Contractor (employees of the Contractor);
persons who are applicants for positions in the Contractor;
persons who are Acceptors of the official offer;
by other users of the Site

The Contractor processes personal data in the following ways:

- non-automated processing of personal data;
- mixed processing of personal data.
During the processing of personal data, the following actions will be performed:

The contractor destroys or depersonalizes personal data upon achievement of the processing goals or in case of loss of the need to achieve the goals.
The Contractor does not collect and process personal data of Users concerning race, nationality, political, religious, philosophical and other beliefs, health status, intimate life, membership in public associations, including trade unions.

The Site uses cookies and visitor data from traffic statistics services (IP address; information from cookies, browser information, access time to the site, the address of the page where the ad block is located, referrer (address of the previous page), browser user-agent data for the purpose of detecting spam and other data).
With the help of this data, information is collected about User actions on the Site in order to improve its content, improve the functionality of the site and, as a result, create high-quality content and services for Users.
The user can change the settings of his browser at any time so that all cookies are blocked or notified when they are sent. At the same time, the User must understand that some functions and services of the Contractor will not be able to work properly.
The Contractor has the right to keep an archived copy of personal data, including after the User deletes the account on the Site.

The User, in accordance with the Federal Law of the Russian Federation dated 07/27/2006 No. 152-FZ "On Personal Data", grants the Contractor the right to process the User's personal data, as well as transfer the right to process the User's personal data to third parties (services and systems) with which relevant contracts have been concluded, to process the User's personal data using automated control systems databases, as well as other software tools specially developed on behalf of the Contractor.
The contract with third parties should define a list of actions (operations) with personal data that will be performed by each legal entity processing personal data and the purposes of processing, the obligation of such a person to respect confidentiality and ensure the security of personal data during their processing should be established, in addition, the requirements for the protection of processed personal data should be specified data.

If the Contractor carries out a cross-border transfer of Users' personal data to the territory of a foreign state, the specified cross-border transfer must be carried out in compliance with the requirements of the current legislation of the Russian Federation, as well as international legal acts.
In this case, the receiving party can only be countries that are parties to the Council of Europe Convention on the Protection of Individuals with Automated Processing of Personal Data and ensure adequate protection of the rights of personal data subjects. The Contractor should be obliged to protect the rights of personal data subjects to the party receiving personal data in accordance with the Convention on the Protection of Natural Persons in the Automated Processing of Personal Data (Strasbourg, 1981).
The processing of the User's personal data is carried out by the Contractor using databases located on the territory of the Russian Federation.
The consent may be revoked by the User or his representative by sending a written statement to the Contractor or her representative.
If the User or his representative withdraws consent to the processing of personal data, the Contractor has the right to continue processing personal data without the User's consent if there are grounds specified in paragraphs 2-11 of Part 1 of Article 6, part 2 of Article 10 and part 2 of Article 11 of Federal Law No. 152–FZ "On Personal Data" dated 07/27/2006.

CONSENT TO THE PROCESSING OF PERSONAL DATA
A user entering into a contractual relationship with the Contractor, as well as submitting an application for registration on the Contractor's Website, paying for the Contractor's products/services, acting freely, of his own free will and in his own interest, as well as confirming his legal capacity, gives his consent to the processing of his personal data to the Contractor.
I accept all the terms of the Privacy Policy posted on the Contractor's Website and give my consent to the Contractor for processing, including automated (mixed method of processing personal data), personal data in accordance with the Federal Law "On Personal Data", including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (provision, distribution, access), blocking, depersonalization, deletion, destruction of personal data.

legal grounds and purposes of personal data processing; information on the methods of personal data processing used by the Contractor;
name and location of the Contractor;
information about persons (with the exception of employees of the Contractor) who have access to
personal data or to whom personal data may be disclosed on the basis of an agreement with the Contractor or on the basis of a federal law; a list
processed personal data related to the User from whom the request was received and the source of their receipt, unless another procedure for providing such data is provided for by federal law;
terms of processing of personal data, including the terms of their storage;
the procedure for the User to exercise the rights provided for by the Federal Law "On Personal Data" No. 152 FZ;
information about the ongoing or proposed cross-border transfer of personal data;
name (full name) and address of the person processing personal data on behalf of the Contractor;
other information provided by the Federal Law "On Personal Data" No. 152 FZ or other federal laws;
to request clarification of their personal data, their blocking or destruction if the personal data is incomplete, outdated, inaccurate, illegally obtained or is not necessary for the stated purpose of processing;
revoke your consent to the processing of personal data;
to demand the elimination of illegal actions of the Contractor in relation to his personal data;
to appeal the actions or omissions of the Contractor to the Federal Service for Supervision of Communications, Information Technology and Mass Communications (Roskomnadzor) or in court if the User believes that the Contractor is processing his personal data in violation of the requirements of Federal Law No. 152-FZ "On Personal Data" or otherwise violates his rights and freedom; to protect their rights and legitimate interests, including compensation for damages and/or compensation for moral damage in court.

the signature of the User (or his legal representative). If the request is sent electronically, it must be issued in the form of an electronic document and signed with an electronic signature in accordance with the legislation of the Russian Federation.
The Contractor, when processing personal data, takes the necessary legal, organizational and technical measures to protect personal data from unlawful or accidental access to them, destruction, modification, blocking, copying, provision, dissemination of personal data, as well as from other unlawful actions with respect to personal data.
Such measures, in accordance with Articles 18.1 and 19 of Federal Law No. 152-FZ "On Personal Data", in particular, include:
a) appointment of a person responsible for organizing the processing of personal data and persons responsible for ensuring the security of personal data;
b) identification of threats to the security of personal data during their processing;
c) development and approval of local acts on the processing and protection of personal data;

f) compliance with conditions that exclude unauthorized access to material carriers of personal data and ensure the safety of personal data; application of technical protection measures, including:
means of access control at the network, application and general system levels;
means of inter-network shielding;
tools for registering and recording user actions at the network, application and general system levels;
antivirus protection tools;
certified cryptographic information protection tools;
intrusion detection tools; security analysis tools;
means of controlling physical access to the premises where personal data is processed;

4. The Customer is an individual, a Site visitor who accepts the terms of this Agreement and wants to purchase the Neural Network Operator Course.
5. The contractor is IP Limarev I. S. (INN: 861713827148 OGRNIP: 317861700091044).
6. Online training (OO) is an online training service for the Course "Neural Network Operator"
7. Website — the official website of the Contractor, located at http://theneuraloperator.com
8. Personal account is a personal page of the Buyer, which he can access by logging in via the social network Vkontakte, Facebook or through a Google account.
9. The parties are the Customer and the Contractor.
10. User Agreement (offer) - means this Agreement - offer for the provision of educational services for the Course "Neural Network Operator".
12. General provisions and procedure for the provision of services.
14. This User Agreement defines the procedure for the provision of paid and free educational services and is a public offer in accordance with Articles 435 and paragraph 2 of Article 437 of the Civil Code of the Russian Federation.
15. Acceptance (consent) in relation to this User Agreement is one of the following actions:
16. - payment for Services in the manner, amount and within the time specified in the offers posted in the relevant section of the Site;
17. -filling out the order form, if the services are provided free of charge.
18. By accepting this Offer, the Customer guarantees that:

The Customer independently monitors all updates and changes to the information received from the Contractor under this User Agreement and is obliged to keep a copy of the Offer with a note on the current version at the time of payment. Changes in the cost, timing and content of the training program do not apply to Services already paid for by the Customer.
22. The subject of this offer is to provide educational services to the Customer remotely in order to obtain knowledge, skills and abilities on the Course "Neural Network Operator" (hereinafter Services).
23. The services under this Offer are provided by the Contractor remotely via the telecommunications network Internet, through software (software), that is, online (remotely).
24. If the Customer chooses the services offered by the Contractor on a paid basis, the Customer pays for the services in the amount and in the manner indicated on the website.
25. Training in the Contractor's author's course within the framework of the provision of Services provided for in the Offer is limited to providing information to the Customer, transferring knowledge and experience of the Contractor according to the training program and developing skills for their independent use by the Customer. All decisions on the use of the acquired knowledge are made by the Customer independently under his own responsibility.
26. The fulfillment of the obligation to provide Services is considered to be the fact of posting the Course Material in closed sections of the Site (Platform) and opening access to them for the Customer within the prescribed time.
27. If the Customer has used the Service, that is, accepted full or partial performance from the Contractor under this User Agreement or otherwise confirmed the validity of the User Agreement, he does not have the right to refer to the fact that the contract is not concluded and the Service was not provided to him.
28. The Parties have agreed that the acceptance certificate for the Services provided under this Offer is not issued.
29. In case of early termination of the contract and refusal of services sold on a paid basis, the Contractor retains the cost of the services actually rendered, which is calculated in proportion to the total cost of Services to the number of lessons/materials provided.
32. Exchange of legally significant messages
33. In order to properly fulfill obligations under this Agreement, the Contractor has the right to notify the Customer by providing the necessary information or requirements that must or may be communicated to the Customer in accordance with the Agreement or the requirements of the current legislation of the Russian Federation. The information is considered to be provided to the Customer properly if the specified information is presented in one of the following ways:
34. Published on the Artist's Website, in the Artist's Telegram Channel;
35. Notified to the Customer upon acceptance of the Offer in the text of the Offer (as of the time of acceptance of the Offer);
36. Notified to the Customer before accepting the Offer at a webinar or other events;
37. Brought to the attention of the Customer by means of electronic messages sent to the Customer by e-mail specified during registration on the Website;
38. Brought to the attention of the Customer using messengers and social networks (Vkontakte, Telegram, WhatsApp, Instagram) by the phone number specified during registration on the Site;
39. Brought to the attention of the Customer by phone call to the phone number specified during registration on the Website.
40. Guarantees and responsibilities
41. The Parties are responsible for violation of the terms of this Offer in accordance with this Offer and the current legislation of the Russian Federation.
42. The Contractor is not responsible for the inability to provide Services to the Customer for reasons beyond the Contractor's control, namely:
43. - disruption of the telecommunications Internet network, equipment or software on the part of the Customer;
44. - failures in the work of e-mail distribution services, including when the Contractor's letters get into the mail service folder - "Spam".
45. The Contractor is not responsible for violation of the terms of this Agreement in case the Customer provides false and/ or incomplete information about himself during the order, including contact information (e-mail, phone number, etc.), as well as in case the Customer does not provide new contact information when they change.
46. No information and materials provided by the Contractor as part of the provision of Services under this Agreement can be considered as guarantees of achieving a result (including earnings), since this completely depends on the actions of the Customer himself, his personal qualities, the quality and speed of mastering / implementing the knowledge and materials received from the Contractor.
47. The Parties are released from liability for full or partial non-fulfillment of their obligations if such non-fulfillment was the result of force majeure circumstances that arose after the entry into force of the Agreement, as a result of extraordinary events that the Parties could not have foreseen and prevented by reasonable measures.
48. In other cases not provided for by the Agreement of non-fulfillment or improper fulfillment of their obligations, the Parties are responsible in accordance with the current legislation of the Russian Federation.
50. Personal data
51. Hereby, in accordance with Federal Law No. 152-FZ "On Personal Data" dated 07/27/2006, the Customer, providing the Contractor with his personal data, within the framework of this Public Offer, confirms his consent to the processing of personal data by the Contractor and its affiliated persons: collection, systematization, accumulation, storage, clarification (update, change), use, blocking, depersonalization, destruction. The above consent is valid for an unlimited period of time. This consent applies to the following personal data: surname, first name, gender, e-mail, date and time of birth, photos uploaded to the personal account, weight, age, hair and eye color, personal preferences (in music, religion, sports, politics, etc.)
52. The Contractor hereby guarantees the confidentiality of the Customer's personal data and non-disclosure of personal data received to third parties.
53. At the written request of the Customer, the Contractor undertakes to destroy the personal data received from the Customer in the Contractor's database within 30 (thirty) business days from the date of withdrawal of acceptance of the Public Offer.
55. Final provisions
56. This Public Offer comes into force from the moment of its acceptance by the Buyer and is valid until the moment of withdrawal of the acceptance of the Public Offer.
57. In the event of any disagreement in connection with this Agreement, the Parties shall take all measures to resolve them through negotiations or in a claim-based manner, while the Parties recognize the relevance and admissibility of evidence obtained through electronic correspondence and/or telephone conversations between the Parties.
58. For the purposes of fulfilling the obligations of the Parties under this Agreement, working days are understood to be working days based on a five-day working week (all days of the week except Saturday and Sunday), which are not public holidays in accordance with the current legislation of the Russian Federation.
59. The seller's website and the services provided may be temporarily partially or completely unavailable due to preventive and other work or for any other technical reasons. The technical service of the Seller's Website has the right to periodically carry out the necessary preventive or other work with or without prior notification to Buyers.
60. If any provision of this Agreement is invalid or unenforceable in accordance with applicable law, all other terms will remain in force, and the invalid or unenforceable condition will be considered replaced by the corresponding valid, enforceable condition of applicable law, which most closely corresponds to the intention of the original condition.
61. Work schedule. Monday-Friday - 9:00-18:00 Moscow time, Saturday-Sunday - day off.
62. This Agreement shall enter into force on October 10, 2023.
